OFFICIAL RULES
1. HOW TO ENTER: NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED. The United States Bowling Congress Clash & Win Instant Win Game and Clash & Win Sweepstakes (collectively, the “Promotion”) comprises two components: (1) a scratch-off instant win game (the “Game”) and (2) the Clash & Win Sweepstakes (the “Sweepstakes”). The Promotion is sponsored by the United States Bowling Congress (“Sponsor”).
2. ELIGIBILITY: The Promotion is open to legal residents of the fifty United States and the District of Columbia who are twenty one (21) years of age or older at the time of entry. Employees, officers or directors of Sponsor, participating Strike Ten Select bowling centers and/or CBS Corporation their affiliates, subsidiaries, advertising and promotional agencies and the immediate family members or household members of such persons are not eligible. Participation in any part of the Promotion constitutes a participant’s agreement to be bound by these Official Rules. Participants agree to be bound by the decisions of the independent Promotion judges and such decisions shall be final.
3. HOW TO PLAY THE GAME: The Game starts on or about April 15, 2008 and ends May 11, 2008 or when Promotion game pieces are no longer available, whichever is sooner (the “Game Period”). During the Game Period, while supplies last, eligible participants may obtain a free scratch-off game card (“Game Card”) at any participating Strike Ten Select bowling center. During the Game Period, while supplies last, eligible participants may request a Game Card by mail by sending a self-addressed stamped envelope (VT and WA residents may omit self-addressed postage) along with a 3” x 5” card with your handwritten name, address, daytime phone number and age to USBC Publishing Dept., 5301 S. 76th St., Greendale, WI 53129 (the “Promotion Address”). Requests made by mail for Game Cards must be postmarked by May 11, 2008 and received no later than May 18, 2008. Limit one Game Card per eligible participant per day, regardless of means of participation. Once you receive a Game Card, scratch off the Instant Win area to reveal whether you have won a prize in the Game. If a message is revealed stating Complimentary Game you are the potential winner of such revealed prize, subject to your compliance with these Official Rules.
4. GAME PRIZES AND ODDS: Each Game Card to be distributed in the Game is designated as a winning Game Card in the Game and will entitle the eligible participant to redeem the Game Card for one complimentary game of bowling at a participating Strike Ten Select bowling center (a “Game Prize”) between May 12, 2008 and September 1, 2008 (the “Redemption Period”). A total of 2,201,000 Game Cards will be printed and available for distribution. The approximate retail value of a Game Prize is $6.00. The odds of winning a Game Prize are 1 in 1. One redemption of a Game Prize per winner, per day during the Redemption Period.
5. HOW TO PARTICIPATE IN THE SWEEPSTAKES. Each Game Card also contains an opportunity to participate in the Sweepstakes. There are multiple promotions running that provide a means to participate in the Sweepstakes. To participate in the Sweepstakes by means of a Game Card, please obtain a Game Card as set forth in Section 3, above. Once you receive a Game Card, scratch off the Grand Prize area to reveal an alpha and/or numeric code (a “Sweepstakes Code”). Then watch the “Bowling’s Clash of Champions” telecast on CBS on May 11, 2008 (check your local listings for time and station) (the “Clash Telecast”). During some portion of the Clash Telecast an alpha and/or numeric code will be shown and designated as the winning code (the “Winning Code”). Such code will have been selected by independent Promotion judges from the alpha and/or numeric codes contained on one of the Game Cards printed for distribution in the Promotion or from one of the other means by which one can enter the Sweepstakes. If the Sweepstakes Code on your Game Card is identical to the Winning Code, you will win the Sweepstakes Grand Prize, subject to verification of eligibility, validation of the Game Card, and compliance with these Official Rules. The Sweepstakes Code will also be posted on bowl.com beginning on May 15, 2008 through May 31, 2008.
If your Game Card Sweepstakes Code contains the exact Winning Code, sign the Game Card and then send the original signed Game Card, along with your name, address, telephone number to Clash & Win Grand Prize Claim 5301 S. 76th St., Greendale, WI 53129. Prize claim must be postmarked by May 31, 2008 and received by June 9, 2008. It is recommended that you retain a photocopy of the Game Card for yourself and that you send it registered mail, return receipt requested. All Game Cards submitted to claim a Sweepstakes Grand Prize become the property of Sponsor and will not be returned. You are not a Sweepstakes Grand Prize winner until your Game Card has been verified, and it is determined that you are eligible and that you have complied with the Official Rules.
6. WINNER NOTIFICATION: If a Game Card containing the exact Winning Code is submitted in accordance with the Official Rules, the individual submitting such Game Card will be contacted via Certified U.S. Mail and/or telephone and/or e-mail on or about the week of June 16, 2008. Such person, at his or her sole discretion, may disclaim the Grand Prize by not claiming such prize or by not completing and returning to Sponsor, Sponsor’s Affidavit of Eligibility and Liability and Publicity Release within fourteen (14) days of attempted notification and in such case an alternate winner will be selected via a Second Chance Drawing and this process will be repeated until such time as a tentative Grand Prize Winner completes and returns Sponsor’s Affidavit of Eligibility and Liability and Publicity Release to Sponsor within fourteen (14) days of attempted notification. At such time, subject to verification by the independent Promotion judges, the tentative Grand Prize Winner will be deemed the Grand Prize Winner. By entering this Sweepstakes and by accepting a prize, the Grand Prize Winner agrees that Sponsor, the independent Promotion judges, and their respective parents, affiliates, subsidiaries, and the officers, directors, agents and employees of any of the above entities are not liable for injury, loss, death, or damage of any kind due to or associated with acceptance, possession, use or misuse of the Grand Prize and/or participation in the Promotion. Except where prohibited by law, Grand Prize Winner further grants to the Sponsor the right to use such Grand Prize Winner’s name, photograph, voice, likeness and city of residence for purposes of advertising or promoting and publicizing the efforts and activities of the Sponsor without further consideration and to release his or her name to persons requesting the names of the winners of the Sweepstakes. Non-compliance or the return of any prize notification as undeliverable may result in disqualification and selection of an alternate winner.
7. SWEEPSTAKES PRIZE; ODDS.
One (1) Grand Prize winner (the “Winner”) will receive the following Grand Prize (the “Grand Prize”) for himself or herself and one traveling companion he or she designates (“Guest”), both of whom must travel together. Guest must be age twenty one (21) or older (unless Guest is the legal child or ward of Winner) and must agree to be bound by these Official Rules and must sign a release consistent with that set forth in these Official Rules as a condition to receipt of and/or participation in the Grand Prize. The Grand Prize is a trip for Winner and Guest to Las Vegas for the 2009 USBC Masters Tournament (the “Masters”) departing on the day immediately preceding the Masters and returning the day immediately following the Masters. The Grand Prize includes round trip coach class flight for Winner and Guest to a major airport selected by Sponsor which is reasonably near Las Vegas (“Destination Airport”) from a major airport selected by Sponsor near Winner’s U.S. principal home address as of May 10, 2008 (the “Home Airport”); ground transportation from the Destination Airport to hotel and back to the Destination Airport; and two (2) nights double occupancy hotel accommodations at a hotel designated by Sponsor, five hundred dollars (total, not each) spending money, admission and transportation to and from the Masters. Approximate maximum retail value of the Grand Prize is Two Thousand Five Hundred Dollars ($2500). Winner and Guest must travel on the same itinerary and at the same time. No transfer or substitution of prizes permitted except where required by law. If the Grand Prize, or any portion of such prize, becomes unavailable, the Sponsor may award a substitute prize of equal or greater value. Odds of a particular Sweepstakes Code matching the Winning Code depend on the total number of Sweepstakes Codes produced in connection with the various means of entry in the Sweepstakes. Taxes on the Grand Prize are the sole responsibility of the Grand Prize Winner and Guest, as the case may be. All expenses, costs and fees not expressly included above are the sole responsibility of Grand Prize Winner and Guest, as the case may be. The total number of prizes to be awarded in the Sweepstakes is one (1) Sweepstakes Grand Prize. Only one Sweepstakes Grand Prize will be awarded. If printing, technical, computer, human or other errors result in more than one eligible valid prize claim then all such eligible prize claims received will be combined in a random drawing from which one will be selected to receive the Sweepstakes Grand Prize subject to verification of eligibility, validation of the Game Card and compliance with these Official Rules.
8. SECOND CHANCE DRAWING. In the event that the Grand Prize is not awarded to the holder of a Sweepstakes Code matching the Winning Code in accordance with the Official Rules, a Second Chance Drawing will be held on or after July 1, 2008 from all eligible Second Chance Drawing entries received. The Second Chance Drawing will be conducted by independent Promotion judges whose decisions are final. To enter the Second Chance Drawing, hand print your name, address, daytime phone, date of birth and email address (email address is optional) on a 3” x 5” piece of paper and mail to the following address: Clash & Win Second Chance Drawing 5301 S. 76th St., Greendale, WI 53129. Entries in the Second Chance Drawing must be received by June 30, 2008. Limit one entry in the Second Chance Drawing per person. Typed, computer generated or otherwise mechanically reproduced outer envelopes and/or entries will not be accepted. Odds of winning in the Second Chance Drawing depend on the number of eligible entries received. If a potential winner is selected in the Second Chance Drawing, such person will be notified by mail and required to fulfill all eligibility requirements applicable to the Sweepstakes. All eligibility requirements of the Promotion apply to the Second Chance Drawing.
For additional copies of the Official Rules, please send a self-addressed stamped envelope to: Official Rules USBC Publishing Dept. 5301 S. 76th St., Greendale, WI 53129. Requests must be received by August 31, 2008. If for any reason the Promotion is not capable of being conducted as contemplated in the Official Rules, including if due to computer virus, bugs, tampering or technical failures which compromise the administration or integrity of the Promotion, Sponsor, in its sole discretion, reserves the right to terminate or modify the Promotion. Sponsor is not responsible for lost, late, stolen, incomplete, illegible, inaccurate, undelivered, delayed, mutilated, postage-due or misdirected mail, correspondence, requests, claims or other errors or problems in connection with or relating to the Promotion, including, without limitation, printing, typographical, human or other error. All Game Cards submitted or redeemed become the property of the Sponsor and none will be returned. Sponsor and independent Promotion judges reserve the right to disqualify any participant who tampers with or attempts to tamper with the Promotion or violates these Official Rules.
9. NAME OF WINNER: For the name of the Grand Prize Winner, available after July 31, 2008 and before September 30, 2008, send a self-addressed stamped envelope (except where not required by State law) to: Sweepstakes Winner’s List at the Promotion Address or visit Bowl.com.
10. PRIVACY: All information submitted as part of this Promotion will be treated in accordance with Sponsor’s Privacy Policy. By submitting information in connection with any portion of the Promotion, each participant agrees to receive promotional materials from the Sponsor. Participants may opt-out from receiving Sponsor’s promotional materials in accordance with Sponsor’s Privacy Policy.
11. RELEASE AND LIMITATIONS OF LIABILITY: BY PARTICIPATING IN THE PROMOTION, PARTICIPANTS AGREE TO RELEASE AND HOLD HARMLESS SPONSOR, ITS AFFILIATES, SUBSIDIARIES, ADVERTISING AND PROMOTIONAL AGENCIES AND ITS AND THEIR OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS (THE “PROMOTION PARTIES”) FROM AND AGAINST ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF PARTICIPATION IN THE PROMOTION OR RECEIPT OR USE OF ANY PRIZE, INCLUDING PROPERTY DAMAGE, PERSONAL INJURY OR DEATH. EACH PARTICIPANT FURTHER AGREES THAT IN ANY CAUSE OF ACTION, THE PROMOTION PARTIES’ LIABILITY WILL BE LIMITED TO THE COST OF PARTICIPATING IN THE PROMOTION, AND IN NO EVENT SHALL THE PROMOTION PARTIES BE LIABLE FOR ATTORNEYS’ FEES, PUNITIVE, CONSEQUENTIAL, DIRECT OR INDIRECT DAMAGES AND EACH PARTICIPANT WAIVES THE RIGHT TO CLAIM ANY DAMAGES WHATSOEVER.
12. DISPUTE RESOLUTION: Except where prohibited by law, each participant agrees that any and all disputes, claims and causes of action arising out of or in connection with the Promotion shall be resolved individually, without resort to any class action, exclusively by the courts located in the judicial district including Greendale, Wisconsin. All issues concerning the construction, validity, and interpretation of these Official Rules shall be governed by and construed in accordance with the laws of the State of Wisconsin (and federal laws, as applicable), without giving effect to any choice of law or conflict of law rules that would result in the application of the laws of any jurisdiction other than the laws of the State of Wisconsin and applicable federal laws.
